These Official Rules ("Rules") govern the ShutterFam photo contest (the "Contest") promoted in connection with designated ShutterFam events. By entering, you agree to these Rules and to the decisions of ShutterFam ("ShutterFam," "Sponsor," "we," or "us"), which are final and binding on all matters relating to the Contest.
1. Sponsor
The Contest is sponsored by ShutterFam. Questions about the Contest may be sent to events@shutterfam.com.
2. Eligibility
The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age at the time of entry and who attended the applicable ShutterFam event in person on the day of the event. Minors are not eligible to enter. Employees, contractors, officers, and directors of ShutterFam, and their immediate family members and members of their households, are not eligible. Void where prohibited or restricted by law.
3. Entry Period
For each designated event, the entry period begins when that event begins and ends one (1) week later at 11:59 p.m. Pacific Time ("Entry Period"). Entries submitted before or after the Entry Period are not eligible. Sponsor's clock is the official timekeeper for the Contest.
4. How to Enter
To enter, during the Entry Period: (a) attend the applicable ShutterFam event in person; and (b) publicly post on Instagram the photograph(s) you intend to enter — captured by you at that event — and tag @shutterfam in the post so we can review it. Tagging @shutterfam in your post is required to enter. Your account and post must remain public for the duration of the Entry Period and judging, or we may be unable to review your entry. Limit: each entrant may be selected to win once per event.
Entries must be your own original work, must not infringe any third party's rights, and must comply with Instagram's terms of use. We may disqualify any entry that is inappropriate, unlawful, or violates these Rules, in our sole discretion.
5. Judging and Winner Selection
This is a contest of skill. Winners are not chosen at random. At each event, entrants are given a colored card and the challenge is to capture a photograph that embodies their assigned color. After the Entry Period closes, eligible entries will be reviewed and judged by a panel selected by Sponsor based on the following criteria, weighted equally unless otherwise stated: (a) creativity; (b) technique; (c) image quality; and (d) theme fit — how well the photo captures and embodies the entrant's assigned color. The entrant(s) with the highest score will be selected as winner(s). In the event of a tie, the tied entries will be re-judged on creativity, and the higher score will prevail. Decisions of the judges and Sponsor are final and binding.
6. Prize
One (1) prize per designated event, unless otherwise stated: one (1) complimentary VIP admission ("ticket") to a future ShutterFam event selected by Sponsor. Approximate Retail Value ("ARV"): US $400. The prize is non-transferable and may not be exchanged or redeemed for cash, except that Sponsor may substitute a prize of equal or greater value if the advertised prize becomes unavailable. The prize covers admission only; travel, lodging, equipment, and all other expenses are the winner's sole responsibility.
7. Winner Notification and Claim
Potential winners will be notified by direct message to the Instagram account used to enter, generally within fourteen (14) days after the Entry Period closes. A potential winner must respond and confirm eligibility within seven (7) days of the notification. If a potential winner cannot be reached, does not respond within that time, declines the prize, is found ineligible, or fails to comply with these Rules, the prize may be forfeited and an alternate winner may be selected based on the next-highest judging score. Sponsor is not required to make more than three (3) attempts to award a prize.
8. Publicity and Content License
By entering, you grant Sponsor a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and share your submitted photo(s) and your Instagram handle for purposes of administering and promoting the Contest and ShutterFam events (for example, reposting on ShutterFam channels), with credit where reasonably practicable. You retain ownership of your photographs. Except where prohibited, entering and/or accepting a prize constitutes your consent to Sponsor's use of your name, handle, likeness, and entry for advertising and promotional purposes without additional compensation.
9. Release and Limitation of Liability
By entering, you release and hold harmless Sponsor and its officers, directors, employees, and agents from any claims, damages, or liability arising out of participation in the Contest or acceptance, use, or misuse of any prize, to the maximum extent permitted by law. Sponsor is not responsible for lost, late, misdirected, or incomplete entries, or for technical failures of any kind.
10. Instagram Disclaimer
This Contest is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. You understand that you are providing your information to Sponsor and not to Instagram. Any questions, comments, or complaints regarding the Contest must be directed to Sponsor, not to Instagram.
11. Privacy
Information collected from entrants is used to administer the Contest and is handled in accordance with our Privacy Policy. California residents have rights under the California Consumer Privacy Act (CCPA/CPRA) as described there.
12. Taxes
All federal, state, and local taxes on a prize are the sole responsibility of the winner. If the value of prizes awarded to a winner in a calendar year is $600 or more, Sponsor may require the winner to complete an IRS Form W-9 and may issue an IRS Form 1099.
13. General Conditions
Sponsor reserves the right, in its sole discretion, to modify, suspend, or cancel the Contest if it is not capable of running as planned, including due to tampering, fraud, technical failures, or any cause beyond Sponsor's reasonable control. Sponsor may disqualify any individual it believes has violated these Rules or acted in an unsportsmanlike or disruptive manner.
14. Governing Law
The Contest and these Rules are governed by the laws of the State of California, excluding its conflict-of-law rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, subject to applicable law.
15. Winners List
For the name of a winner for a given event, send a request to events@shutterfam.com within sixty (60) days after that event's Entry Period closes.
